Russell S. Roeca

Russ Roeca is a founding partner of boutique AV rated Roeca Haas Montes De Oca LLP, an active trial lawyer and certified mediator. He has tried dozens of cases to jury verdict, court trials, arbitrations, both binding and non-binding. Russ is certified by the State Bar of California as a specialist in Legal Malpractice Law. He is also a certified mediator and has successfully mediated many matters to successful resolution.

Russ’ practice principally focuses upon professional liability of attorneys, real estate and healthcare professionals, as well as related commercial and business litigation. His professional liability practice includes representing attorneys, in various capacities, including efforts to recover rightfully owed attorney fees or in defense of professional liability litigation and disciplinary investigations before the State Bar of California. He also represents parties to real estate transactions, including principals, real estate agents, and brokers. Russ has represented a San Francisco based dental school over the past 25 years. Russ has been named a “Super Lawyer” by his colleagues in the profession since 2006 and is rated AV Preeminent by Martindale Hubbell.

In addition to his active trial practice, Russ is active in the community. He served as 2009 President of the Bar Association of San Francisco and served as a member of the Board of Governors of the State Bar of California from 2001 to 2004. Russ was also a member of the State Bar Committee on Professional Liability Insurance and served as co-chair from 2010 through 2012. He previously served on the State Bar Insurance Disclosure Task Force and on the State Bar’s Council on Access & Fairness as a founding member chairing its Judicial Committee. Russ currently represents the Bar Association of San Francisco by appointment as its Delegate to the ABA’s House of Delegates.

Russ has served as arbitrator for the San Francisco Superior Court for more than 15 years and has handled hundreds of matters as a court appointed arbitrator. He is also a mediator certified by the Bar Association of San Francisco and has successfully handled more than three dozen matters. Russ is proud of his success rate.

Professional Liability and Commercial Litigation

In over thirty years of practice, Russ’ extensive jury trial experience has included representation of attorneys in a wide range of practice areas, commercial and residential real estate agents and brokers, insurance agents and brokers, prosecution and defense of real estate fraud, and prosecution and defense of actions for malicious prosecution. He has represented a wide variety of healthcare professionals. Russ and his partners also work with their clients in the transactional setting as part of loss prevention and quality assurance.

Russ has represented institutional clients providing loss prevention guidance and auditing services, and served many years a member of a national healthcare company’s major claims strategic evaluation committee, evaluating claims for strategic planning purposes.

His extensive representation of attorneys also includes partnership and fee disputes, defense of disciplinary claims, and counseling on ethical issues.

Educational, Professional, and Community Activities

Russ’ professional activities include membership in the American Bar Association, the Bar Association of San Francisco, and the State Bar of California. He served as Chair of the Legal Malpractice Committee and on the Board of Directors of the Bar Association of San Francisco before his nomination as an Officer in 2006. Russ frequently serves as a court appointed judicial arbitrator in San Francisco, and as a panelist with the Bar Association of San Francisco’s early settlement program, and has served as judge pro tem for the Alameda County Superior Court over the years.

Russ served as President of the Bar Association of San Francisco in 2009. He previously represented the 4th District (San Francisco and Marin County) as a member of the Board of Governors of the State Bar of California. He served as BASF’s liaison to the Bench Bar Coalition currently represents BASF as its delegate to the ABA House of Delegates. He also served eight years as a Commissioner on the San Francisco Fire Commission, appointed by Mayor Brown in 1996.

As reflected above Russ is active in the community. He values diversity in the profession and has worked to open the profession to be more reflective of society. Before first becoming a Director of the Bar Association of San Francisco in 1994, Russ was a member of the Bar’s diversity committees and has championed the Law Academy high school Classroom to Career program co-sponsored by the Bar Association of San Francisco and the San Francisco Board of Education.

He contributes pro bono and financial support to the Aids Legal Referral Panel and the Volunteer Legal Services Program of BASF over the years. He served on the Board of Governors of the Human Rights Campaign from 1994 until 1998 and is a longstanding member of the Bay Area Lawyers for Individual Freedom.

Russ received his B.A. degree from the University of California, Los Angeles, in 1976 and his law degree from the University of California, Hastings College of the Law in 1980. He is admitted to practice in California state and federal courts, and the United States Supreme Court.

Russ Roeca was honored to be named the 2010 Myer J. Sankary Lawyer of the Year, Small & Solo Firms, by the State Bar of California. In 2011 the Bench Bar Coalition named Russ Bar Leader of the Year.
